Mediators encourage one on one communication with the goal of resolving disputes to avoid litigation. Mediation is also effective in dealing with a variety of issues that are not necessarily legal in nature. A neutral third party can positively change the dynamics of just about any negotiation/conflict.
A mediator encourages complete and honest communication to delve into the root causes of conflict and encourage the parties to thoroughly discuss each issue. Conflict is scary for most people. A mediator provides a safe environment for exploring the conflict and creating a mutually agreeable resolution.
Many mediation cases result in a settlement. If your mediation is successful, you'll leave with a signed agreement or memorandum stating what both parties have agreed to. If you don't reach a resolution through mediation, then you still have the option of pursuing legal action.
